KC labeling requirements under the RADIO WAVES ACT
Under Article 58-2 (6) of the RADIO WAVES ACT (전파법), imported goods subject to KC Certification under the RADIO WAVES ACT shall have KC labeling if they are to be sold.
Under Article 23 (2) of the RRA Notification, NOTIFICATION ON
CONFORMITY ASSESSMENT OF BROADCASTING AND COMMUNICATIONS EQUIPMENT, ETC. (방송통신기자재등의 적합성평가에 관한 고시), in the case of imported goods, KC labeling shall be done prior to
customs clearance. So, it is recommended to consider the KC labeling from the
stage of manufacture.
Requirements of KC labeling are prescribed in Table 5 annexed to the
RRA Notification, which was amended on April 18, 2023.
Amended on April 18, 2023 2. Labeling method A. The
indication of the fact that conformity assessment has been conducted in
accordance with Article 58-2 (6) of the RADIO WAVES ACT refers to the
labeling of basic design of national certification mark specified in Section
1, identification code, and conformity assessment information specified in
Section 2, b (hereinafter referred to as "conformity assessment
marking"). B. Conformity
assessment information refers to the information regarding the company name
(or trade name) of the person who has received the conformity assessment, the
name of the equipment (or product), the model name, the
information that allows identification of the manufacturing date (e.g.,
manufacturing year and month, a lot number composed of a combination of
manufacturing year and month, a marking that includes a combination of
manufacturing year and month to allow the manufacturer to prove the
manufacturing date, etc.), and the manufacturer and country of manufacture. However,
if consumers cannot identify the manufacturing date based on the information
provided in the main text, the manufacturing date shall be separately
indicated or the information that allows verification of the manufacturing
date shall be provided through user manuals, packaging, websites, etc. ※ If a product that has undergone conformity
assessment is manufactured in multiple countries, indicate the country where
the product is finally manufactured. C.
Conformity assessment marking [including electronic labeling according to
Section 3 (hereinafter referred to as "e-labeling")] shall be
firmly attached to each device by printing, engraving, or other methods on
the surface and packaging of the product to ensure easy identification.
<Clause deleted> (The labeling method for packaging shall be based on
the minimum packaging unit, and in the case where multiple types of products
are contained in one package, the identification code of the product with the
main function may be selected and indicated.) D. In spite of paragraph C, in the following cases, certain parts of the
conformity assessment marking may be omitted: 1) If it is determined that it is difficult to display the conformity
assessment information on the product and its packaging considering its
impact on the product design, it may be indicated in the user manual
(including electronic means). 2) For small-sized products with a maximum cross-sectional area of 400 ㎟ or less, if it is not possible to display the conformity assessment
marking on it, it is allowed to attach the conformity assessment marking on
the product's packaging or indicate only the basic design or identification
code on the product. 3) If the model name stated in the conformity assessment application is the
same as the model name used for the sale and promotion of the product, only
the national certification mark specified in Section 1 and the model name may
be indicated. However, both the identification code and the conformity
assessment information shall be included in the user manual. 4) If it is difficult to display the conformity assessment marking on the
product's surface, such as implantable pacemakers, etc. it may only be
indicated on the product's packaging. 5) If transparent packaging material is used, allowing the conformity
assessment marking to be visible in the packaged state, the conformity
assessment marking on the packaging may be omitted. 6) Find grammar
errors in: For importers, if they provide stickers or other means so that the
purchasers directly attach the conformity assessment marking to the product's
surface, the conformity assessment marking on the product may be omitted. E. When posting on the internet for the purpose of selling or renting,
the conformity assessment marking shall be displayed at the top of the page
where the product is posted or below the product price. The identification
code shall be displayed in text format, and a link to the following URL
("http://www.rra.go.kr/conform/identification code") may be
provided to verify the authenticity of the identification code. F. The size of the conformity assessment marking may be adjusted
according to the product's size, but the vertical height shall not be less
than 5mm. However, for extremely small products such as storage devices,
etc., or products that use certification seals (such as stamps, imprints, or
engravings, etc.), the vertical height may be adjusted to a size identifiable
based on the product's size. G. The size of the conformity assessment marking may be scaled down or up
in proportion to the size of the equipment, and special color effects may be
applied based on the product's characteristics. H. The identification code may be displayed on the bottom of the basic
design or in a visible place on the product. If there are two or more identification
codes, each code may be listed under one basic design. I. Method of displaying identification code
In Box ①, 'R' is displayed to indicate the conformity assessment of broadcasting
and communications equipment, etc., under the RADIO WAVES ACT. In Box ②, as basic KC Certification information, indicate the 'Identification
code of KC Certification type'.
In Box ③, as basic KC Certification information, indicate 'S' only for cases of
conformity certification or registration of the same equipment. (The term "same equipment" refers to the equipment that has the
same equipment name, model name, manufacturer, country of manufacture,
electrical circuit, parts, structure, performance, appearance, etc., as the
one that has obtained conformity certification or registration under Article
58-2 of the RADIO WAVES ACT.) In Box ④, indicate the ‘applicant identification code’ issued by the RRA
Administrator under Article 5 of the RRA Notification. In Box In Box ⑤, indicate the applicant's 'product identification code (allowing the use
of alphanumeric characters, hyphens (-), and underscores (_))', which can be
determined by the applicant within 14 characters. J. If wireless transmitting/receiving parts, slot-type detachable wired
fax modules, or toy motors that have undergone conformity assessment are used
as components of a finished product, the conformity assessment identification
code of the components shall be displayed on the finished product. |

According to the amended requirements of KC labeling, various ways of
indicating manufacturing date are allowed.
However, it shall be noted that only the ways that make consumers
confirm the manufacturing year and month through reasonable means are allowed. The
ways that only the manufacturer can access to the information of the
manufacturing date are not allowed.
